1. Introduction

Welcome to Padaia. By using our app and services, you agree to these Terms of Service. Please read them carefully before using the app.

Padaia is an app that lets you schedule padel matches, invite fellow players, and manage all your padel contacts and locations in one place. The service is provided by Padaia (hereinafter: "we", "us" or "Padaia").

These terms apply to the Padaia mobile app (iOS and Android) and the website padaia.app.

2. Acceptance of Terms

By creating an account or using the app, you confirm that you have read and agree to these Terms of Service. If you do not agree with (any part of) these terms, you may not use the app.

We reserve the right to modify these terms at any time. In the event of significant changes, we will notify you through the app or by email. Continued use of the app after a change constitutes acceptance of the updated terms.

3. Account and Registration

To use Padaia, you need to create an account. The following conditions apply:

  • You provide accurate and complete information during registration and keep it up to date.
  • You are solely responsible for the security of your account and password. Do not share your login credentials with others.
  • You may not create an account in the name of or on behalf of another person without their explicit consent.
  • You will notify us immediately at support@padaia.app if you suspect that your account has been compromised or misused.

In the event of abuse, fraud, or violation of these terms, we reserve the right to temporarily suspend or permanently delete your account.

4. Use of the Service

4.1 Permitted Use

You may use Padaia for:

  • Scheduling and managing padel appointments
  • Inviting fellow players to matches
  • Managing your padel contacts and favourite locations
  • Receiving notifications about invitations and upcoming matches

4.2 Prohibited Use

It is not permitted to:

  • Use the service for illegal activities or in a manner that violates applicable laws and regulations.
  • Provide false, misleading, or offensive information.
  • Send unsolicited messages or spam to other users.
  • Attempt to circumvent, decompile, hack, or disrupt Padaia's technical systems.
  • Use automated scripts, bots, or other automated means to access the service.
  • Use the service in a way that harms or impairs the experience of other users.
  • Infringe on the intellectual property rights of Padaia or third parties.

5. User Content

You are solely responsible for any content you upload or share via Padaia, including your profile photo, name, and match details. By uploading content, you grant Padaia a non-exclusive, worldwide, royalty-free licence to use, process, and store that content to the extent necessary to provide the service.

You warrant that any content you share does not infringe the rights of third parties and is not contrary to applicable law or these terms.

We reserve the right to remove content that violates these terms or is otherwise inappropriate, without prior notice.

6. Intellectual Property

All rights to the Padaia app, including its design, source code, graphic elements, texts, and trade marks, belong to Padaia or its licensors. These terms grant you only a limited, personal, non-transferable right to use the app for personal, non-commercial purposes.

It is not permitted to:

  • Copy, decompile, or reverse-engineer the app or any part thereof.
  • Distribute, sell, or sublicence the app or parts thereof to third parties.
  • Use the Padaia brand name, logo, or other visual identity elements without prior written permission.

7. Availability and Disclaimer

We strive for the highest possible availability of the service, but cannot guarantee it. The service may be temporarily unavailable due to scheduled maintenance, updates, or unforeseen technical issues. We will endeavour to notify you in advance where reasonably possible.

Padaia is provided "as is" and "as available". We make no warranties, express or implied, regarding the uninterrupted availability, security, or error-free operation of the service.

Location data in the app is sourced from OpenStreetMap and other public sources. While we strive for accuracy, we do not warrant the completeness or correctness of this data.

Please note: Padaia is a tool for organising padel matches. We are not liable for matches that do not take place, venue issues, or other circumstances beyond our control.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Padaia shall not be liable for:

  • Indirect, consequential, special, or incidental damages, or loss of profits or reputation.
  • Loss or corruption of data.
  • Damages resulting from the temporary or permanent unavailability of the service.
  • Damages caused by the actions or omissions of other users.
  • Inaccuracies in location data or other information provided by third parties.

If Padaia is found liable, our total liability in any case shall be limited to the amount you have paid to Padaia in the twelve months preceding the event giving rise to the claim, with a maximum of €50.

Nothing in these terms excludes liability that cannot be limited or excluded under mandatory applicable law, such as liability for wilful misconduct or gross negligence.

9. Termination

You can delete your account at any time via Profile → Settings → Delete account in the app. After deletion, your personal data will be permanently erased within 30 days in accordance with our privacy policy.

We reserve the right to suspend or terminate your access to the service if:

  • You violate these terms.
  • We are required to do so under applicable law or regulation.
  • We decide to change or discontinue the service.

In the event of service discontinuation, we will notify you at least 30 days in advance where reasonably possible.

10. Governing Law and Disputes

These Terms of Service and your use of Padaia are governed by Dutch law.

Any disputes arising from or relating to the use of Padaia shall be submitted exclusively to the competent courts in the Netherlands. As a consumer, you may also make use of the European ODR platform for dispute resolution.
